SCOMET declaration format for exporters, with sample wording
The SCOMET declaration format exporters use to confirm goods are off the SCOMET list, when customs asks for it, and how the EUC and licence differ.
SCOMET declaration format for exporters
A SCOMET declaration is the exporter's signed statement that the goods are not on the SCOMET list, usually worded after the DGFT ANF-4F declaration clause. It is not a prescribed customs form, and it is not the End Use cum End User Certificate (EUC) for listed goods.
The official wording DGFT uses
DGFT prints the clause in its ANF forms. Clause 5 of the declaration in ANF-4F reads:
"I/ We hereby declare that I/we have perused the list of SCOMET items as contained in the Appendix 3 to the Schedule 2 of the ITC (HS) Classifications of Export-Import Items and that the item(s) exported / proposed to be exported does not fall within this list and that I/ We agree to abide by the provisions of the Policy for export of SCOMET items contained in the Foreign Trade Policy, Schedule 2 of ITC (HS) and the HBP v1, irrespective of the scheme under which the item is exported / proposed to be exported (the underlined portion will be deleted in case an application for export license for SCOMET item is being filed)."
The clause still refers to HBP v1, so cite the current Handbook of Procedures 2023 when you adapt it.
Sample SCOMET declaration format on letterhead
Use this adaptation of the DGFT clause on your letterhead. It is a starting point, not a CBIC-prescribed form:
Declaration regarding SCOMET items
Exporter: [name, address], IEC: [number] Invoice no. and date: [ ] / Shipping bill no. (if allotted): [ ] Item description: [ ] / ITC(HS) code: [ ]
We hereby declare that we have perused the list of SCOMET items in Appendix 3 to Schedule 2 of ITC(HS), SCOMET List 2025, and that the item(s) exported under the above invoice do not fall within this list.
We further declare that we have not received any notice from DGFT about these items, and we do not know or have reason to believe that they will be used in or diverted to weapons of mass destruction, their missile delivery systems or military end use.
Signature, name, designation, date, company stamp
Ask your customs house or CHA what they expect before you fix the wording.
The second paragraph follows the catch-all in HBP para 10.05. An unlisted item still needs a SCOMET authorisation on ANF 10A if DGFT has told you so in writing, or if you know or have reason to believe it could be used in or diverted to WMD, a missile system or military use, including by terrorists or non-state actors.
SCOMET declaration meaning
SCOMET stands for Special Chemicals, Organisms, Materials, Equipment and Technologies (Handbook of Procedures, Chapter 10). The list is Appendix 3 to Schedule 2 of ITC(HS). The current edition is the SCOMET List 2025 (as on 23.09.2025), notified by DGFT Notification 31/2025-26 on 23 September 2025. Because the 2025 edition now fills Category 7 with certain emerging technologies and related items, don't sign against a 2024 PDF.
A SCOMET declaration (the DGFT clause) and the EUC (Appendix 10J(i)) are different documents:
| Document | Who signs | When it is used |
|---|---|---|
| Non-SCOMET declaration | The Indian exporter | Goods are not on the list. DGFT scheme forms include the clause, and customs may ask for it with the shipping bill. |
| End Use cum End User Certificate (Appendix 10J) | Foreign buyer, consignee, end user and any intermediary | Goods are on the list and a SCOMET authorisation is being applied for |
When customs or DGFT asks for it
The Shipping Bill (Electronic Integrated Declaration and Paperless Processing) Regulations, 2019 contain no SCOMET-specific declaration.
Officers do ask for it case by case, though. A Bangalore Customs query list has a 27 January 2024 query on shipping bill 7041573 that reads: "SCOMET DECLARATION IS NOT SUBMITTED ALONG WITH SUPPORTING DOCUMENTS. PLEASE CLARIFY WHETHER THE ITEMS FALLS UNDER SCOMET CATEGORY OR NOT".
Mumbai Air Cargo Export Public Notice 50/2025-26 (3 October 2025) says a status dispute can mean demurrage while the cargo waits. It reproduces CBIC Instruction 26/2025-Customs (14 August 2025). Where coverage is unclear, "the final determination is made by the SCOMET Cell at DGFT in consultation with the Technical Authorities concerned under the aegis of the IMWG". Exporters can ask DGFT before shipping. A Chartered Engineer certificate is not required for SCOMET classification or export clearance. If the CBIC repository (Instruction 15/2025-Customs) and the local file do not settle the question, field officers refer it to Customs-III rather than straight to DGFT.
The EUC format in Appendix 10J
For a DGFT SCOMET application, HBP para 10.04 requires an EUC. Appendix 10J has three versions:
- Appendix 10J(i) for Categories 2, 3, 4, 5 and 8, and for re-export from a stockist to the ultimate end user under Stock & Sale, other than Category 1 chemicals
- Appendix 10J(ii) for Category 1 chemicals, which must also give purity or concentration, IUPAC name, CAS number and ITC(HS) code
- Appendix 10J(iii) for Stock & Sale exports to an overseas stockist
Each supply-chain entity fills Appendix 10J(i) on its own letterhead, signed in ink. The four parts cover the parties, the goods, the end-use undertakings and the signatory. Software or technology also needs the explanatory letter in that form. Use the official text, not this summary. Upload the PDF with the application and post the original to the SCOMET Cell, DGFT (HQ), Vanijya Bhawan, New Delhi.
How it differs from a SCOMET licence
Neither declaration is permission to export. Under HBP para 10.02, items on the SCOMET list "are permitted against an export authorisation, unless prohibited or specifically exempted." File ANF 10A to 10F online at DGFT, under Services > Export Management System > SCOMET (HBP para 10.04). DGFT licenses the categories other than Category 0 and Category 6. Category 0 is with the Department of Atomic Energy. The rest of Category 6, the Munitions List, is with the Department of Defence Production. Under HBP para 10.17, a SCOMET authorisation is valid for 24 months unless stated otherwise. GAEC (chemicals and related equipment) runs for 5 years, with quarterly post-reporting. GAICT, GAER and the other general authorisations in that paragraph have their own periods. Once issued, the Mumbai Customs Zone III FAQ says the details go to customs through ICEGATE and "The SCOMET license number must be mentioned in the shipping bill."
If the declaration is false
Section 18 of the WMD Act, 2005 covers false declarations relating to items notified under that Act. Signing or using one you know or have reason to believe is materially false attracts a minimum fine. This is five lakh rupees or five times the items' value, whichever is more.
Check the current list before signing. You can see the cited answer to this question, including the catch-all rule, on the RegAffairs AI answer page. For a past export-control violation, HBP para 10.19 provides for voluntary self-disclosure to scomet-dgft@nic.in.
