What a REACH Only Representative does under Article 8

Under Article 8 REACH, a non-EU manufacturer, formulator or article producer may appoint an EU-based Only Representative by mutual agreement. The representative fulfils the importer obligations under Title II, which covers registration.

Article 8(2) also applies the other importer obligations. The representative must have enough background in the practical handling of substances and the related information. They must keep available and up to date information on quantities imported, customers sold to and supply of the latest safety data sheet update. Under Article 8(3), the manufacturer informs importers in the same supply chain. Those importers become downstream users.
